Status of the Regulation 1107/2009 – Current Challenges and Opportunities

At the 2021 Dublin Plant Protection Symposium, Laurent Oger, Director for Regulatory Affairs at CropLife Europe, spoke about the “Status of the Regulation 1107/2009 – Current Challenges and Opportunities”

He started by describing the main issues currently going on with regulation 1107/2009: problems with the zonal system, the ability of authorities to comply with legal timelines, an increased reliance on emergency authorizations, and a decreasing number of approved active substances.

The presentation continued with a description of some areas the Commission is working on nowadays. The EC is implementing the new transparency regulation, which is a major change and implies extra work on the applicant side. The comparative assessment is not really working, and the Commission has mentioned that there would be changes in this regard to increase the cases of actual substitutions. There is also work being done at the Commission level on cumulative risk assessments, a negligible-exposure document, the alignment of risk mitigation measures at the EU level, and data requirements for safeners and synergists.

Big developments affecting biopesticides are also taking place. There have been adaptations of the data requirements for microorganisms, for example. But other technologies such as pheromones, peptide or antibody-insecticides or RNA technologies also need additional consideration, as they are expected to become more and more prevalent.

Laurent finished his presentation talking about other policies that will have a big impact in the future of EU agriculture: changes in the MRL/IT legislation (environmental factors to be included), Green Diplomacy (EU wants to export this model to other countries/regions), sustainable food systems (which will imply sustainability assessments), REACH derived restrictions and CLP revision stemming from the chemical strategy for sustainability.
